Tax Allocation District Consent Inquiries
The Henry County Board of Education strives to be wise stewards of public funds. The Georgia Constitution requires that tax funds generated in support of public education be used exclusively for that purpose and the Board regards this constitutional requirement as the creation of a fiduciary obligation of the highest order.
In 2009, the Georgia Constitution was amended to allow school boards to contribute education taxes to Tax Allocation Districts. The Board recognizes the economic vitality of our communities plays a key role in students’ well-being and as such created Board Policy DFA - Local Tax Revenues - to establish the process and parameters by which inclusion of education taxes to support redevelopment within a tax allocation district may be considered without detriment to the Board’s constitutional mission of education.
Application and Process Overview
Applicants seeking consent of the Henry County Board of Education for participation in a tax allocation district (TAD) must submit an application no later than August 1 of the year prior to the year in which it is proposed to begin the intercept of the education tax increment. Applications must be submitted using the process outlined on the form provided.
The CFO's office will review applications for completeness, advise the Board of receipt and then route to an internal review committee for evaluation. The committee may reach out to the applicant with questions/clarifications or request to present. After evaluation, the application and committee assessment will be presented to the Board for a decision.
